WISCONSIN--I heard about the unsuccessful challenge on Sam Arora's page set up by John St Michael. It was unanimous. I am sick of Repub legislatures thinking that they can simply do this kind of thing because they don't like a group of people. MI did this and they in fact DID scrap protections from domestic partnerships. The WI State Supreme Court's decision might be used as ammo as they said that marriage, civil unions and domestic partnerships were the same--anyone who understands these issues know that they are NOT THE SAME THING!


We have to send a clear picture to these people In WI, what can we do so that this doesn't end up a repeat of what happened in MI and leaving so many couples as legal sitting ducks? Any ideas

Wis. Governor Doesn't Care About the Law, Dislikes Gay Things

Lawyers defending the state in a Wisconsin case regarding domestic partnerships have been fired by the state's Governor, Scott Walker. This may not sound bizarre, but think about it: the lawyers were defending the state's domestic partnership law. The governor who was around before Walker, Jim Doyle, put into his budget a domestic partner registry, which went into effect in August 2009. The registry provided same-sex couples with limited rights, like hospital visitations and inheritance, if they opted to join. It even extended health care benefits to same-sex partners of government workers! Sounds fabulous, right?

Well, not to conservatives in Wisconsin.

The Wisconsin lawsuit, which was filed by Wisconsin Family Action's President Julaine Appling, challenged the registry, claiming it violates the state's ban on same-sex marriage. (An anti-gay marriage referendum was approved by 59 percent of voters in 2006.)

Walker is looking for new people to fill the shoes of his terminated firm, Cullen Weston Pines & Bach- probably people who are more aligned with his perspective. He has not indicated if the state is even going to continue pursuing the case. But is this the appropriate way to end a conversation about same-sex marriage after 5 years? In fact, is it even appropriate to end that conversation? Well, no, but to people who know Walker, this isn't even that weird:

Pines, who also represented Bill McConkey in his ultimately unsuccessful challenge to the state's constitutional ban on gay marriage, says he expected to be fired from the case. In fact, he is surprised it took this long.

"Gov. Walker is ideologically opposed to equal rights for gay and lesbian and transgendered people as is everyone in his administration as far as I can tell and they will be probably want to take steps to ensure that gay and lesbian and transgendered people do not have equal rights," Pines said.

"Everything that Gov. Walker is doing is ideological," Pines added. "I don't see that his administration has any particular respect for the law per se."

Awesome!

We've already posted here on how important gay legislators and lawmakers are to creating and sustaining change in the gay marriage arena, and this is the perfect example of how that can be a threat to our existing framework â€" and how scared it makes people. Even though Wisconsin already has this registry, the opportunity to destroy those rights is now opportune and, apparently, possible through inexplicable phenomena like firing completely qualified and uncontroversial lawyers working for your state. Sound shady? It is. Sound shitty? Very.

So, a Governor with "no respect for the law" sounds troubling, but what sounds even more troubling TO HIS AGENDA is the fact that after Pines was let go for, erm, no reason, gay couples from Wisconsin intervened in the case. That's right â€" it's a girlfight now:

Fair Wisconsin, a statewide gay rights advocacy group, asked to intervene in the lawsuit, and several same-sex couples are now also defendants in the suit. The Chicago office of the Lambda Legal Defense and Education Fund, a civil rights organization that focuses on gay issues, represents these couples and will continue to do, says attorney Christopher Clark.

So the bad news is, the Governor of Wisconsin is afraid of same-sex marriage and is upholding that fear with his power, against all odds, and no matter what the costs. But the good news? It's totally transparent and totally obvious, and that makes it twice as tacky. If organizations like Fair Wisconsin work hard to represent the importance of equality for, well, everyone under the law (sound familiar? It should, it's our creed), they will hopefully be able to pick up where Walker left it off. Let's just hope the case continues, and doesn't just come to a standstill, because well… that's kind of how court cases should work. But hey, apparently anything goes.

  • Boycott Bill O'Reilly and FOX News and their advertisers.  Bill discussed a French commercial by McDonalds that was meant to show that McDonalds is Gay Friendly. Bill said what is next? Is McDonalds going to be Al-Qaida friendly as well?  Imagine - Bill O'Reilly compares Gays to Al-Qaida!
  • Boycott Arizona the home of  "hater" - U.S. Senator John McCain. Arizona's Hateful anti-Immigration Law - encourages racial profiling and increases hatred towards minorities.  A remedy: Demand Republicans to  support Immigration Reform (The Dream Act). Further, Senator McCain voted against ending DADT and Blocked Immigration reform! 
  • Boycott Target, Best Buy, Gold's Gym - for donating money towards anti-gay political candidates/organizations. Update: (12/26/2010): Target is continuing to donate to anti-gay groups/causes/politicians. Update 03/08/11 - Lady Gaga Ends Target Partnership, Reportedly Over Target's Poor LGBT Stance. Update 3/25/2010 - Target displays their hypocrisy and Sues California Gay Rights Group for Lobbying Outside Stores.  Target is attempting to block the LGBT right of free speech!  STOP SHOPPING AT TARGET!!!!!!!!!!!!!!!!!
  • End DOMA (Defense of Marriage Act).  Prevents Federal employees and Gays in the Military from gaining equal benefits. Prevents Gay Partners from gaining equal benefits.    
  • Pass ENDA (Employee Non-Discrimination Act).  ENDA would prevent employment discrimination of  LGBT workforce.
  • Boycott Salvation Army as they will not hire Gays! "DO NOT DONATE TO THEM."
  • BOYCOTT "Chick-fil-a" for donating to anti-gay marriage groups.
  • BOYCOTT KOCH INDUSTRIES PRODUCTS- to include their products: Angel Soft toilet paper / Brawny paper towels / Dixie plates, bowls, napkins & cups / Mardi Gras napkins and towels / Quilted Northern toilet paper / Soft 'n Gentle toilet paper / Sparkle napkins / Vanity fair napkins / Zee napkins / Georgia-Pacific paper products & envelopes / All Georgia-Pacific lumber & building products (INVISTA Products) / Lycra / Stainmaster Carpet.   The billionaire - Koch brothers are ultra republican - tea bag founders/supporters that do not support causes of the LGBT community.
  • Boycott WALMART - The National Gay and Lesbian Task Force, force criticized Wal-Mart for denying employee benefits to same-s-x partners and for failing to prohibit discrimination based on gender identity. By comparison, the group said two other chain stores with a strong presence in New York, Costco and Walgreens, did much better.
  • NEW: Boycott Donald Trump, The Apprentice and NBC Network! Trump stated he is considering a run for president as a Republican. In a interview with the Des Moines Register, Trump added that he opposes all forms of legal recognition for gay couples, not just marriage. "They should not be able to marry," he said. So why does NBC keep the Apprentice running - when Donald Trump has stated he may run for president? Boycott NBC! Boycott advertisers of The Apprentice and Trump's other business's. Don't shop at any building with Donald Trump's name!  The Donald has expressed extreme Hatred.  Remember how poorly he treated Rosie O'Donnel?  Now we know why he did that!  It was hate against a lesbian as we now know he is hater.  Unforgiveable!  Ready to dump NBC because they air Donald Trump's "The Apprentice"?  Start Watching CBS Evening News with Katie Couric.
  • NEW: Boycott "APPLE." For the current owners and the aspiring owners of the I-phone,  Apple allows an application, "The Gay App", which is supposed to help gay individuals turn straight.  This is a step in the wrong direction.
    Apple needs to know that the decision to allow this App on their products is a fallacious idea! Update: March 23, 2011:  Apple removed this app from USA stores; but, possibly not from foreign stores.  This is offensive not just towards the LGBT community in the USA; but, offensive to  the entire LGBT community around the world.  How does anyone approve such a hateful, despicable app towards the LGBT community? Especially when Gay Teens are killing themselves after being harrassed by their church, parents, as well as  by bully's and teachers at school. The idea that this app was used, solicited is disgusting.

few blocks from our home and we are in there often.
Our home is full of kitchen items and furniture from

Target sues solicitors, triggers free speech debate

A small, largely unknown group of same-sex marriage activists from San Diego has been sued by one of the world's biggest retailers -- and drawn into a broader dispute that involves one of the world's most well-known entertainers.

The case has broad implications for free speech, assembly and property rights - and perhaps more immediate ramifications for the retailer, Target, which has been besieged by negative publicity amid a widening rift with gay-rights supporters.

The local lawsuit follows a March 1 incident at a Poway Target between a shopper and a persistent activist from the Hillcrest-based Canvass for a Cause. Target's response has left some members of the gay and lesbian community feeling alienated by the company -- and left Target fending off accusations of anti-gay sentiments -- for the third time since July.

Last summer, Target CEO Gregg Steinhafel apologized for one of the company's campaign contributions, which benefited a Minnesota gubernatorial candidate who supported economic growth and job creation but opposed same-sex marriage.

Then this month, Lady Gaga backed out of a deal to sell a special edition of her new album at Target, reportedly because she was unhappy with how the company's politics affect the gay community.

Target maintains in this case it's simply trying to make shopping "distraction-free," based on court rulings over the years that it interprets as allowing retailers without public-gathering areas to ban all solicitors, from the Salvation Army to political groups.

"To provide a distraction-free shopping environment for our guests, Target's long-standing policy is that we do not permit solicitation or petitioning at our stores regardless of the cause or issue being represented," it said in a statement Friday. "Our legal action in California against Canvass for a Cause is in no way related to the cause of the organization. Target has taken similar action against a number of organizations, including churches and advocacy groups that represent a wide variety of issues."

Target also noted that it supports "inclusivity and diversity in every aspect of our business. Target believes in equality, does not discriminate and is not anti-LGBT. We are committed to creating an environment where team members and guests feel welcome, valued and respected."

Bernard Schroeder, an expert in marketing at San Diego State University, said Target should have seen the latest flap coming and instead of suing Canvass for a Cause to keep it from its doorsteps, Target should have taken to the court of public opinion.
 
A full-page newspaper ad calling attention to the company's support of the gay and lesbian community, its disdain for solicitors who can be a harassment to shoppers and its financial contributions to a wide range of community activities would have fueled a more favorable media storm, he said.

"They may have not chosen the perfect mitigation tactic by taking them to court," said Schroeder, a 22-year marketing executive turned professor and program director of the university's Entrepreneurial Management Center. "They're going to lose even if they win."

Meanwhile, Tres Watson, executive director of Canvass for a Cause, found himself fielding more than 110 phone calls Friday about his nonprofit group. He and three others formed it 18 months ago to lobby for same-sex marriage nationwide.

Watson spoke with journalists from Canada and the United Kingdom and did 11 radio interviews, in locales as far flung as Minnesota, Georgia and Florida.

Also Friday, San Diego Superior Court Judge Jeffrey Barton spent about half an hour listening to arguments from both sides of the lawsuit.

He may issue a ruling on Target's request for a restraining order in a week or two.

Representing Target was Los Angeles attorney David McDowell from the law firm Morrison Foerster. On the activists' side was San Diego lawyer Bryan Pease.

McDowell did not return repeated requests for comment.

"The issue is, where can people engage in speech activity in a shopping center?" Pease said. "They've invited the public in. The question is, once they've done that, how much free speech does the public have?"

In its statement Friday, Target stressed its support for the gay community, outlined a range of domestic partner benefits it offers and added that it has a nearly 1,000-member LGBT Business Council that acts as a resource for LGBT employees and advises the company "about LGBT guests."

Outside the Target store in Mission Valley on Friday, two canvassers spent the afternoon asking shoppers and other passers-by if they support gay marriage, then engaging them in conversation either way.

Such efforts can lead to hundreds of voter contacts and 20 to 40 conversations a day with supporters and detractors, said lead field manager Shannon Dove.

"We're not being offensive," she said. "We're asking questions politely, and they can walk away."

Most did just that. A few walked by without saying a word or even acknowledging the women's presence.

Some stopped and talked. Many of those ended up signing a list that Canvass for a Cause said may be used when same-sex marriage returns to a ballot.
