Do Prisoners Really Spend All Their Time Lifting Weights?

No, but they can watch all the yoga videos they want.

The Supreme Court ruled on Monday that crowding at California prisons constitutes cruel and unusual punishment, and ordered the state to reduce the number of inmates by more than 30,000. An outraged Justice Scalia dissented, noting that many of the released prisoners "will undoubtedly be fine physical specimens who have developed intimidating muscles pumping iron in the prison gym." Do people really get super-buff in the slammer?

Not anymore. It's true that most state and federal prisons had extensive collections of free weights and weight machines through the 1980s, and that inmates could spend significant portions of their days bulking up. But that all changed around 20 years ago. As stories about prison gyms spread in popular culture, they became an increasing source of public concern. Some shared Scalia's worry that muscle-bound ex-cons would be even more dangerous after their release, and legislators across the country responded. In 1996, an amendment to an appropriations bill expressly prohibited the federal Bureau of Prisons from purchasing "training equipment for boxing, wrestling, judo, karate, or other martial art, or any bodybuilding or weightlifting equipment of any sort." Many states, including California, made the same decision, either by statute or policy. These days, whatever free weights you'd still find in U.S. prisons are decades old. (These are often chained to the walls, to deter thieves and prevent inmates from beating each other with barbells.)

Prisoners get most of their exercise in the yard, a large outdoor space with a track and basketball court. In warm-weather states like California, there may be some exercise equipment in a covered gym area adjacent to the yard. There are some complicated rules governing this equipment in federal prisons: Roman chairs are acceptable, because they work the nonthreatening abdominals, while back- and bicep-building chin-up bars are verboten. Many federal prison administrators avoid confusion by limiting inmates to cardio machines like stationary bikes and treadmills. State prisons, which typically have tighter budgets, sometimes have no exercise equipment at all. Most facilities do, however, stock a selection of yoga and meditation videos.

The lack of free weights and weight machines hasn't completely prevented prisoners from packing on "intimidating muscles," as Justice Scalia calls them. In the absence of iron to pump, they turn to whatever heavy items they can find. Resourceful prisoners check out books from the library for the sole purposes of lifting them. Those who work in the mess hall can hoist large pots full of water. They do pull-ups from the rails of their bunk beds, which are sometimes stacked three- or even four-high in the crowded California penitentiaries. And there may be serious competition for access to the gym area, where younger, stronger inmates exclude their weaker colleagues. In several prisons, inmates have developed their own rules for using and maintaining decrepit exercise gear.

Despite popular approval, sociologists and many prison officials have criticized the prohibition on weights in correctional facilities. Some research suggests that weight lifting decreases aggression among inmates. Wardens have noted that idleness is the biggest threat to order in a prison, and weight lifting gives the convicts something to do.

  • Boycott Bill O'Reilly and FOX News and their advertisers. Bill discussed a French commercial by McDonalds that was meant to show that McDonalds is Gay Friendly. Bill said what is next? Is McDonalds going to be Al-Qaida friendly as well? Imagine - Bill O'Reilly compares Gays to Al-Qaida!
  • Boycott Arizona the home of "hater" - U.S. Senator John McCain. Arizona's Hateful anti-Immigration Law - encourages racial profiling and increases hatred towards minorities. A remedy: Demand Republicans to support Immigration Reform (The Dream Act). Further, Senator McCain voted against ending DADT and Blocked Immigration reform!
  • Boycott Target, Best Buy, Gold's Gym - for donating money towards anti-gay political candidates/organizations. Update: (12/26/2010): Target is continuing to donate to anti-gay groups/causes/politicians. Update 03/08/11 - Lady Gaga Ends Target Partnership, Reportedly Over Target's Poor LGBT Stance. Update 3/25/2010 - Target displays their hypocrisy and Sues California Gay Rights Group for Lobbying Outside Stores. Target is attempting to block the LGBT right of free speech! STOP SHOPPING AT TARGET!!!!!!!!!!!!!!!!! Update 4/8/2011: Target lost it's case to stop the LGBT from canvassing in front of their stores. A huge PR Disaster for TARGET! Perhaps Target should go out of business as they betrayed their investers and customer base. Target contributed massive funds to a politician who would like to exterminate gays. Now, Target can not stop us from Boycotting them, nor picketing, nor talking to customers near their stores; although, Target allows a anti-gay company such as the Salvation Army to stand outside their door and speak with customers and raise money. Isn't this a double standard?
  • End DOMA (Defense of Marriage Act). Prevents Federal employees and Gays in the Military from gaining equal benefits. Prevents Gay Partners from gaining equal benefits.
  • Pass ENDA (Employee Non-Discrimination Act). ENDA would prevent employment discrimination of LGBT workforce.
  • Boycott Salvation Army as they will not hire Gays! "DO NOT DONATE TO THEM."
  • BOYCOTT "Chick-fil-a" for donating to anti-gay marriage groups.
  • BOYCOTT KOCH INDUSTRIES PRODUCTS- to include their products: Angel Soft toilet paper / Brawny paper towels / Dixie plates, bowls, napkins & cups / Mardi Gras napkins and towels / Quilted Northern toilet paper / Soft 'n Gentle toilet paper / Sparkle napkins / Vanity fair napkins / Zee napkins / Georgia-Pacific paper products & envelopes / All Georgia-Pacific lumber & building products (INVISTA Products) / Lycra / Stainmaster Carpet. The billionaire - Koch brothers are ultra republican - tea bag founders/supporters that do not support causes of the LGBT community.
  • Boycott WALMART - The National Gay and Lesbian Task Force, force criticized Wal-Mart for denying employee benefits to same-s-x partners and for failing to prohibit discrimination based on gender identity. By comparison, the group said two other chain stores with a strong presence in New York, Costco and Walgreens, did much better.
  • Remember David Kato, Gay activist - Uganda, who was slain because he is gay!
  • NEW: "Tune Out Trump", Boycott all Trump Hotel, casinos, holdings, The Apprentice and NBC Network! At CPAC, Trump said he is considering a run for president as a Republican. In a interview with the Des Moines Register, Trump added that he opposes all forms of legal recognition for gay couples, not just marriage. "They should not be able to marry," he said. So why does NBC keep the Apprentice when Donald Trump has stated he may run for president? After making racist remarks about Obama and recv'g public backlash, Trump decided not to run for president after NBC renewed his awful TV Show. How can NBC re-new the clown's show after he pulled such hateful shenanigans? Boycott NBC! Boycott advertisers of The Apprentice and Trump's other business's. Don't shop at any bullding with Donald Trump's name to include Trump Hotels, Casinos, Condo's, Offices, Shops! The Donald has expressed extreme Hatred towards gays and blacks with his birther remarks and anti-gay rhetoric. Remember how poorly Trump treated Rosie O'Donnel? Now we know why he did that! It was hate against a lesbian as we now know he is biget. Unforgiveable! Again, Dump NBC because they air/re-newed Donald Trump's "The Apprentice"! Start Watching CBS Evening News.
  • NEW: Boycott "APPLE." For the current owners and the aspiring owners of the I-phone, Apple allows an application, "The Gay App", which is supposed to help gay individuals turn straight. This is a step in the wrong direction.

Texas Is Very Confused About Its Same-Sex Marriage Ban

 A Texas judge declared a marriage between a transgender woman and her firefighter husband invalid, yesterday. Nikki Araguz and Thomas Trevino Araguaz III, who died on the job last year, had been legally married for three years under the Texas Family Code, a law updated in 2009 to allow people who have undergone court-recognized sex or name changes to obtain marriage licenses. A 1999 appeals court ruling, however stipulates that despite the existence of a reissued birth certificate, for the purposes of marriage, your gender at birth is all that matters in Texas. Gender is "fixed at birth by the Creator," the decision reads. Of yesterday's ruling, Houston civil rights advocate Noel Freeman said, "The transgender community jumps through a lot of legal hoops --records of sex changes, amended [and legally binding] birth certificates--to try to live the same life that everybody else gets to live. This is a very frustrating setback."

State representative Lois Kolkhorst, sponsor of the 2009 law, had no idea her bill would effectively legalize a form of same-sex marriage in Texas. "All of that is very unfortunate," she told the Texas Tribune, adding that the legislature should "get that clarified." However, contradictory laws around transgender rights and same-sex marriage are hardly a new issue in Texas or elsewhere in the United States. In the five years after the "fixed at birth" ruling in Texas at least two couples married legally, according to Slate. The Kansas Supreme Court also faced a similar case in 2007 when the step-son of a transgender woman challenged her right to inherit the $2.5 million estate of her late husband. The court ruled in favor of the step-son and argued that the transgender woman bore no spousal rights as their once-legally recognized marriage was, in retrospect, never actually legal. Contrarily, a California judge ruled the opposite in 1997 when he refused to invalidate the marriage between a transgender male and his wife.

It's somewhat ironic how Texas legislatures cornered themselves into a progressive policy. Especially given the timing. A University of Texas/Texas Tribune poll out yesterday showed a strong majority of the state's residents are in favor of allowing either gay marriage or civil unions. This finding comes on the heels of a Gallup poll corroborated what many others had before: the majority of Americans also support "marriages between same-sex couples." Activists, like the transgender woman picture above, are also actively fighting for equal rights in the face of discrimination in states like Illinois, where the state's complicated process to legally change genders is causing grief. Then again, the irony was not lost last year when Texas appeals court ruled that same-sex couples could not legally divorce, a move that one blogger likened to forcing gay marriage.

The sad truth of yesterday's ruling suggests more than a very confused Texas state legislature. The Araguaz case Texas, like the case in Kansas, boils down to money. The late husbands' family and ex-wife had argued that the $600,000 in death benefits should go to his sons rather Nikki Araguaz, who was never really his wife, they said. After effectively overlooking the contradiction for two years--or not noticing or whatever--the Texas court turned its attention to the issue over relatives hungry for a big check. It's a little disheartening in any case to see dollars at the crux of a much bigger civil rights struggle.
