The question was asked, whether or not if we know of any companies that Are self insured, thus not required to pay partner benefits or same sex marriage benefits for health coverage.

My best friend from high school, works for Southwest Airlines, based here in Dallas Texas at Love Field Airport. He is a flight attendant and is based in Houston Texas. Southwest Airlines is a self insured company regarding healthcare coverage.

American Airlines, also based here in Dallas Texas at DFW International Airport, was 1 of the first companies in the 90's to offer domestic partner healthcare benefits, even though they were not required to do so. They are not self insured as far as healthcare, but the flight attendant union is what argued that airline into starting domestic partner health care benefits.

Southwest Airlines, being self insured for healthcare benefits, and based in Dallas Texas, started offering domestic partner health care benefits quite a few years after American Airlines. They legally fought to not give in to the flight attendant union, but ultimately the flight attendant union won. Very different scenarios with 2 airlines both based in texas, NOT a same sex marriage state!

Same-Sex Spouses in New York Will Get Health Insurance

Getting health insurance should become easier for gay couples who decide to marry and live in New York, which recently became the sixth state to legalize same-sex marriage.

Couples that marry will gain a variety of other legal and financial benefits as well, but the ability to add a spouse to an employer's plan may be one of the more significant. When we calculated the extra costs that gay couples incur because of their inability to marry, health care expenses were certainly among the most onerous -- not all employers offer domestic partner insurance, for instance. And even when they do, workers are often taxed on the value of those benefits.

Though the legalization of same-sex marriage in New York won't entirely level the playing field with opposite-sex married couples, it will certainly help matters. Not only will the same-sex spouses of state workers be eligible for spousal coverage, but the same goes for many employees who work for private employers. According to the state insurance department, an employer that provides coverage to spouses must now also extend that coverage to same-sex spouses who were legally married in New York.

In fact, since New York State already recognized same-sex marriages performed elsewhere, gay couples who were married have been eligible for spousal coverage for some time. The New York State Insurance Department issued guidance in 2008 clarifying its position, noting that same-sex spouses were indeed to be treated as spouses for health insurance purposes (and other insurance matters as well).

Still, there could be some instances were spouses may not be eligible for coverage. Employers who don't contract with an insurance company but instead pay for health benefits out of their own assets -- so-called "self-insured plans" -- are not subject to the state's insurance laws. Instead, the plans are governed by a federal law, the Employee Retirement Income Security Act, known as Erisa, which is likely to rely on the federal definition of marriage (one man and one woman).

So an employer with a self-insured plan could choose to cover same-sex spouses, but it's not required, said Todd Solomon, a partner in the employee benefits practice at McDermott Will & Emery and author of "Domestic Partner Benefits: An Employer's Guide."

And since the federal government still doesn't recognize same-sex marriage, workers with same-sex spouses will continue to owe federal income taxes on the value of their spouse's benefits, unless they're considered a dependent. (Heterosexual married couples aren't subject to the taxes because they're viewed as an economic unit in the eyes of the federal government.) While more employers have begun reimbursing their workers for those extra costs, it's still a relatively small number that do.

But now that same-sex marriage is legal at the state level, employees will no longer owe state income taxes on the value of those benefits, according to a spokeswoman for the state department of taxation.

  • Boycott Target, Best Buy, Gold's Gym - for donating money towards anti-gay political candidates/organizations. Update: (12/26/2010): Target is continuing to donate to anti-gay groups/causes/politicians. Update 03/08/11 - Lady Gaga Ends Target Partnership, Reportedly Over Target's Poor LGBT Stance. Update 3/25/2010 - Target displays their hypocrisy and Sues California Gay Rights Group for Lobbying Outside Stores. Target is attempting to block the LGBT right of free speech! STOP SHOPPING AT TARGET!!!!!!!!!!!!!!!!! Update 4/8/2011: Target lost its case to stop the LGBT from canvassing in front of their stores. A huge PR Disaster for TARGET! Perhaps Target should go out of business as they betrayed their investers and customers. Target contributed massive funds to a politician who would like to exterminate gays. Now, Target can not stop us from Boycotting them, nor picketing, nor talking to customers near their stores; although, Target allows a anti-gay company such as the Salvation Army to stand outside their door and speak with customers and raise money. Isn't this a double standard? Perhaps TARGET would better understand the issue if they cared about David Kato - Uganda, who was slain because he is gay! That is because Uganda wants to kill gay people. Again, TARGET invested in a political candidate that would Kill the Gays!
  • End DOMA (Defense of Marriage Act). Prevents Federal employees and Gays in the Military from gaining equal benefits. Prevents Gay Partners from gaining equal benefits.
  • Pass ENDA (Employee Non-Discrimination Act). ENDA would prevent employment discrimination of LGBT workforce.
  • Boycott Salvation Army as they will not hire Gays! "DO NOT DONATE TO THEM."
  • BOYCOTT "Chick-fil-a" for donating to anti-gay marriage groups.
  • BOYCOTT KOCH INDUSTRIES PRODUCTS- to include their products: Angel Soft toilet paper / Brawny paper towels / Dixie plates, bowls, napkins & cups / Mardi Gras napkins and towels / Quilted Northern toilet paper / Soft 'n Gentle toilet paper / Sparkle napkins / Vanity fair napkins / Zee napkins / Georgia-Pacific paper products & envelopes / All Georgia-Pacific lumber & building products (INVISTA Products) / Lycra / Stainmaster Carpet. The billionaire - Koch brothers are ultra republican - tea bag founders/supporters that do not support causes of the LGBT community.
  • Boycott WALMART - The National Gay and Lesbian Task Force, force criticized Wal-Mart for denying employee benefits to same-s-x partners and for failing to prohibit discrimination based on gender identity. By comparison, the group said two other chain stores with a strong presence in New York, Costco and Walgreens, did much better.
  • NEW: "Tune Out Trump", Boycott all Trump Hotel, casinos, holdings, The Apprentice and NBC Network! At CPAC, Trump said he is considering a run for president as a Republican. In a interview with the Des Moines Register, Trump added that he opposes all forms of legal recognition for gay couples, not just marriage. "They should not be able to marry," he said. So why does NBC keep the Apprentice when Donald Trump has stated he may run for president? After making racist remarks about Obama and recv'g public backlash, Trump decided not to run for president after NBC renewed his awful TV Show. How can NBC renew the clown's show after he pulled all such low-class shenanigans? Boycott NBC! Boycott advertisers of The Apprentice and Trump's other business's. Don't shop at any bullding with Donald Trump's name to include Trump Hotels, Casinos, Condo's, Offices, Shops! The Donald has expressed extreme Hatred towards gays and blacks with his birther remarks and anti-gay rhetoric. Remember how poorly Trump treated Rosie O'Donnel? Now we know why he did that! Gay Marriage Act's Impact on Heterosexual Marriage

Whether straight men and women know it or not, New York's new Gay Marriage Act will have an enormous impact on them. The reason? It will eliminate or at least drastically reduce the likelihood of gays attempting to conceal or even change their orientation through heterosexual marriage.

In the past, many gay people did not identify with or even fully understand what homosexuality was, or their relationship to it. In earlier centuries, for example, intense and sustained same-sex relationships were considered unremarkable. And because notions of privacy were still practised largely in the breach, it was customary for friends -- even strangers -- to save money or make do with limited space by sharing beds and many did so.

At the same time, homosexuals "caught" being homosexual were treated as criminals. In 1953, for example, President Dwight Eisenhower's Executive Order 10450 required all civil and military federal employees guilty of "sexual perversion" to be fired, and thousands were. As late as 1965, Canada imprisoned a gay mechanic as a "dangerous sexual offender" after he admitted to having consensual sex with other men. He was released only in 1971, when the tide began to change.

The consequence, of course, was that most lesbians and gay men married opposite-gender spouses and tried as best they could to fit into the heterosexual mould their society expected, not infrequently indulging in clandestine gay liaisons.

These are the marriages that the Gay Marriage Act will mostly end. And some of its most fervent supporters have been the heterosexual spouses of closeted homosexuals. These gay husbands and their wives and ex-wives, and lesbian wives and their husbands and ex-husbands number in the millions, and number in the millions -- between 1.7 and 3.4 million -- and are increasingly speaking out about how their experience has affected them personally. The Straight Spouse Network, for instance, use a virtual community "for all the millions of us who find that we are married or in a long term relationship with someone who we find out is gay, lesbian, bisexual, transgendered, or just not sure about that." Television's Fran Drescher's show Happily Divorced is inspired by her real-life experience as a straight woman whose husband reveals, post-divorce, that he is gay.

But the right to gay marriage will reduce but not eliminate these marriages; only eradicating homophobia will do that. There remains a chasm between official policy and the realities of personal and social life: parental rejection, social ostracism or mockery, and physical danger that includes being bashed as a "fag." Coming out can still be perilous, and many young gays prefer the safety of being closeted. The complexities of gayness are heightened as expatriate gays who once lived clandestinely in their homelands seek to make sense of North American inclusiveness.

For the first time in history, young people are growing up in the presence of legally sanctioned gay marriage (and divorce), an experience that will influence how they shape their lives in a world that is marching away from homophobia and allowing gays and lesbians to unite in marriage, to raise their children, and to expect to receive the same rights and to be subject to the same obligations as heterosexual spouses. As more gay men and women decide to marry, they will shore up the very institution whose decline the wider society mourns.
