HIV-Positive Chicago Man Says He Was Denied Life-Saving HIV Medication While Jailed

A 39-year-old HIV-positive Chicago man claimed Wednesday that he was denied access to medication prescribed to help him manage his condition during a seven-day jailing in the Bureau County Jail last fall.

The American Civil Liberties Union of Illinois issued letters detailing the complaints on behalf of the man, Arick Buckles, to the Bureau County Sheriff and Illinois Department of Corrections on Monday.

According to those letters, Buckles was detained from September 29 through October 6 last fall on an outstanding warrant for a non-violent crime. While being processed into the jail, Buckles claimed he notified multiple staff members, including a nurse, that he was HIV-positive and needed medication to ensure his consistent treatment. A friend, his partner and a Chicago area case management provider also contacted the prison informing them of the importance of the medication. He was, however, allegedly denied access to that medication throughout his prison stay, an action which appears to be in violation of an Illinois statute. According to records obtained by the ACLU, the jail referenced the medication's high cost as their principal motivation behind denying it.

The ACLU's letters also outlined Buckles' concern over the jail's handling of some of his possessions in a way that may have revealed his HIV status to other detainees, in violation of the AIDS Confidentiality Act. While not seeking any damages, the organization is calling on the jail to ramp up their training pertaining to handling HIV-positive detainees and providing them with medication. They also called on the state Department of Corrections to investigate the jail's practices.

"Bureau County has an obligation under the Constitution to provide the medical care necessary for all persons they detain," said John Knight, director of ACLU of Illinois's Lesbian, Gay, Bisexual and Transgender Project. "For Arick, his HIV medications were not optional and should not have been debated on the basis of cost to the County … And the human costs of putting Arick's life at risk and putting him through the agony of wondering if he'll ever get treatment far outweigh the purchase price of Arick's HIV medication."

According to a Chicago Sun-Times report, the Department of Corrections is currently investigating Buckles' complaint. Bureau County Sheriff John Thompson declined to comment on the case.

Both the ACLU of Illinois and the AIDS Foundation of Chicago said experiences like Buckles' were not uncommon. Nationally, at least 16 lawsuits were filed in the last year contending that HIV-positive individuals were denied life-saving medications while incarcerated, the Sun-Times reported.

Buckles works as an HIV/AIDS educator in Chicago and is an active member of the Illinois Alliance for Sound AIDS Policy, a group that works to "develop, nurture, and support statewide HIV policy and advocacy" across the state. He was recognized with an "advocate of the year" award earlier from the AIDS Legal Council of Chicago earlier this year.

  • Boycott Arizona the home of "hater" - U.S. Senator John McCain. Arizona's Hateful anti-Immigration Law - encourages racial profiling and increases hatred towards minorities. A remedy: Demand Republicans to support Immigration Reform (The Dream Act). Further, Senator McCain voted against ending DADT and Blocked Immigration reform!
  • Boycott Target, Best Buy, Gold's Gym - for donating money towards anti-gay political candidates/organizations. Update: (12/26/2010): Target is continuing to donate to anti-gay groups/causes/politicians. Update 03/08/11 - Lady Gaga Ends Target Partnership, Reportedly Over Target's Poor LGBT Stance. Update 3/25/2010 - Target displays their hypocrisy and Sues California Gay Rights Group for Lobbying Outside Stores. Target is attempting to block the LGBT right of free speech! STOP SHOPPING AT TARGET!!!!!!!!!!!!!!!!! Update 4/8/2011: Target lost it's case to stop the LGBT from canvassing in front of their stores. A huge PR Disaster for TARGET! Perhaps Target should go out of business as they betrayed their investers and customer base. Target contributed massive funds to a politician who would like to exterminate gays. Now, Target can not stop us from Boycotting them, nor picketing, nor talking to customers near their stores; although, Target allows a anti-gay company such as the Salvation Army to stand outside their door and speak with customers and raise money. Isn't this a double standard?
  • End DOMA (Defense of Marriage Act). Prevents Federal employees and Gays in the Military from gaining equal benefits. Prevents Gay Partners from gaining equal benefits.
  • Pass ENDA (Employee Non-Discrimination Act). ENDA would prevent employment discrimination of LGBT workforce.
  • Boycott Salvation Army as they will not hire Gays! "DO NOT DONATE TO THEM."
  • BOYCOTT "Chick-fil-a" for donating to anti-gay marriage groups.
  • BOYCOTT KOCH INDUSTRIES PRODUCTS- to include their products: Angel Soft toilet paper / Brawny paper towels / Dixie plates, bowls, napkins & cups / Mardi Gras napkins and towels / Quilted Northern toilet paper / Soft 'n Gentle toilet paper / Sparkle napkins / Vanity fair napkins / Zee napkins / Georgia-Pacific paper products & envelopes / All Georgia-Pacific lumber & building products (INVISTA Products) / Lycra / Stainmaster Carpet. The billionaire - Koch brothers are ultra republican - tea bag founders/supporters that do not support causes of the LGBT community.
  • Boycott WALMART - The National Gay and Lesbian Task Force, force criticized Wal-Mart for denying employee benefits to same-s-x partners and for failing to prohibit discrimination based on gender identity. By comparison, the group said two other chain stores with a strong presence in New York, Costco and Walgreens, did much better.
  • Remember David Kato, Gay activist - Uganda, who was slain because he is gay!
  • "Tune Out Trump", Boycott all Trump Hotel, casinos, holdings, The Apprentice and NBC Network! At CPAC, Trump said he is considering a run for president as a Republican. In a interview with the Des Moines Register, Trump added that he opposes all forms of legal recognition for gay couples, not just marriage. "They should not be able to marry," he said. So why does NBC keep the Apprentice when Donald Trump has stated he may run for president? After making racist remarks about Obama and recv'g public backlash, Trump decided not to run for president after NBC renewed his awful TV Show. How can NBC re-new the clown's show after he pulled such hateful shenanigans? Boycott NBC! Boycott advertisers of The Apprentice and Trump's other business's. Don't shop at any bullding with Donald Trump's name to include Trump Hotels, Casinos, Condo's, Offices, Shops! The Donald has expressed extreme Hatred towards gays and blacks with his birther remarks and anti-gay rhetoric. Remember how poorly Trump treated Rosie O'Donnel? Now we know why he did that! It was hate against a lesbian as we now know he is biget. Unforgiveable! Again, Dump NBC because they air/re-newed Donald Trump's "The Apprentice"! Now the Donald Claims the Long Form Birth certificate is a fraud. And NBC keeps this guy?

Huntsman isn't 'evolving' on gay marriage like Obama

I have made no secret of my admiration for Jon Huntsman. The former Utah governor's consistent message of civility in the campaign and towards the president is welcome in a party that seems to have forgotten it. And his willingness to take positions that he knows could doom his candidacy is the very definition of leadership. But it is how Huntsman characterizes his courageous position on one of those issues that has me putting down my pom-poms.

When asked about marriage equality, Huntsman is forthright. He believes that marriage is between a man and a woman. He told the folks on "Morning Joe" yesterday that it would be "impossible" to change the definition of marriage to include loving and committed same-sex couples and that he wouldn't be in favor of such a change. In the same breath, however, Huntsman expresses support for civil unions. This puts him in a very lonely place in the Republican field for president. But it's how he says it that irks me.

"But I believe, just subordinate to marriage we have not done an adequate job in the area of equality and reciprocal beneficiary rights," Huntsman said. You catch that? "Just subordinate to marriage"? He repeats that line every time he's asked the question. The first time I heard it was during an interview with George Stephanopoulos last month. And it's bothered me ever since. You can't get to equality if you're pushing a "subordinate" institution.

Civil unions was a major milestone in 2000, when then-Gov. Howard Dean (D) signed a bill making Vermont the first state in the union to grant to same-sex couples the same rights and responsibilities that accrue to straight married couples. By 2004, even President George W. Bush (R) went on record supporting them. Over the next seven years we have seen the tide shift dramatically towards greater acceptance of full marriage equality for same-sex couples.

No one has been able to articulate why civil unions just doesn't cut it anymore as an alternative to marriage equality better than Republican super lawyer Ted Olson. He and Democratic super lawyer David Boies are challenging California's Proposition 8, which added a ban on same-sex marriage ton the state's constitution by voter referendum in 2008. At a briefing last month on their efforts, Olson explained why "marriage" matters.

At the end of the day, the word marriage means something. It isn't just the institution of marriage. It is the words themselves. Our proponents argued vigorously that the word marriage meant something very, very important so that that should be limited to certain people marrying someone of the opposite sex . And that domestic partnerships or civil unions would be just fine for the rest of America because marriage meant something very, very special. Well, that because it means something very, very special is why it is wrong to deny it to some of our citizens. Just like the word citizen means something. You could say to someone you could have all the rights of a citizen -- you can vote, you can travel, you can do all these things -- but you can't call yourself a citizen you wouldn't be an American then, would you? And if you can't be married, you don't have the same rights or same status or same dignity, same respect that other people do.

President Obama holds the same position as Huntsman on marriage equality. But unlike Huntsman, Obama says his thinking on the issue is "evolving." The president is taking a lot of heat of late for his stance on same-sex marriage. But on this I have to agree with Greg Sargent. Obama will come out in favor of marriage equality for gay and lesbian couples. It's just a matter of when.
