Off-Label Use of H.I.V. Medications Is Catalyst for More Controversy

By SCOTT JAMES - Sep 23, 2011 - NY Times

At a cafe on 18th Street in San Francisco, David sipped coffee and talked about the regimen of daily H.I.V. pills he recently started: Viread in July, and then last month, Isentress. He looked exhausted.

David does not have H.I.V. For 20 years he has endured a debilitating case of chronic fatigue syndrome, which has left him unable to work.

"All of a sudden my brain dies," said David, who asked that only his first name be used for privacy reasons. "I have such a narrow range of concentration." He hopes the medications will help.

Thirty years into the AIDS epidemic, the antiretroviral drugs that have provided lifesaving treatment for many of those infected with H.I.V. -- 1.1 million in the United States today -- are now being used or considered for treating other ailments.

When medications have proved safe and effective for most patients, it is standard practice for pharmaceutical companies to see if the drugs have other applications. But with H.I.V. drugs, the practice has been unusually contentious, fostering debates about questionable science, safety and profiteering, and concerns that thousands of Americans infected with H.I.V. cannot get the medications.

At the center of this controversy is Gilead Sciences, a pharmaceutical company based in Foster City. Gilead is the nation's largest producer of H.I.V. medications (including Viread, Truvada, and Atripla), accounting for nearly half the United States market for them. The drugs produce $3.5 billion in annual revenues, with profit margins reportedly twice the industry average.

The Food and Drug Administration approved Viread to treat chronic hepatitis B in adults in 2008. And after a 2009 study linked chronic fatigue syndrome -- a mysterious tiredness believed to afflict a million Americans -- to a retrovirus called XMRV, there was hope that H.I.V. drugs might also work against that ailment.

But that idea soured when other scientists could not reproduce the study's results and concluded that the findings were incorrect. Science, the medical journal that published the research (conducted by the Whittemore Peterson Institute of Reno) has taken the unusual step of asking for a retraction. The institute declined to comment for this column.

Many doctors still believe that some type of virus, even if not XMRV, causes chronic fatigue, and an unknown number of patients continue to try H.I.V. drugs as a treatment. With a doctor's prescription, Dave said he received his medications from drug makers without charge, because of his low income.

But critics say the speculative use of H.I.V. medications is ethically dubious because a growing number of Americans infected with H.I.V. are apparently unable to get the medications.

Atripla, a combination of three H.I.V. drugs including Viread, wholesales for nearly $20,000 per patient annually. The recession has created greater need for financial aid, with jobless Americans losing health insurance, and strapped states (11 so far, but not California) have placed infected people on waiting lists to receive medication free or at reduced cost -- more than 9,000 now, up from just 100 in 2008.

"They are giving these lifesaving drugs to people who do not have H.I.V., while those who need them are going without," said Ged Kenslea, a spokesman for AIDS Healthcare Foundation, a patient advocacy group and medication provider.

Mr. Kenslea said there was also concern about research into using the drugs as prophylaxis, to prevent H.I.V. infection in high-risk groups. Research in San Francisco and elsewhere has found that preventative use is only partly effective, raising safety concerns that such use would create a false sense of protection and increase infections. The foundation has protested the idea in news media campaigns and at Gilead's headquarters.

Officials at Gilead declined to be interviewed. But in an e-mail, Gregg Alton, a Gilead vice president, said the company recognized the "crisis" emerging with states' H.I.V. medication financing and had reduced or frozen prices and was providing drugs for free to many on waiting lists.

"We take our responsibility to patients seriously and we are working hard to ensure that H.I.V. patients who need our medicines have access to them, regardless of their ability to pay," Mr. Alton wrote.

Cara Miller, a Gilead spokeswoman, acknowledged in e-mails that the use of the company's drugs for H.I.V. prevention, rather than just disease treatment, has spurred a discussion "about an important topic." She also wrote that Gilead had not knowingly given away drugs for free for treating chronic fatigue, since that was not an approved use.

Approved use or not, David continues the regimen, hoping for results. "I just had five days of what I call C.F.S. hell," he said. "I couldn't leave the apartment."
Take Action:
  • Boycott advertisers of Glenn Beck's radio show and his guest spots on Fox News. Glenn Beck is anti-gay rights. Update: Boycott Successful: Update 4/7/2011: Beck has been fired by FOX NEWS! Radio stations dropping Beck as well in several locations. Now, tell FOX to stop having Beck as a Guest.
  • Update: DADT has been repealed. President Obama has kept his promise!
  • Boycott Bill O'Reilly and FOX News and their advertisers. Bill discussed a French commercial by McDonalds that was meant to show that McDonalds is Gay Friendly. Bill said what is next? Is McDonalds going to be Al-Qaida friendly as well? Imagine - Bill O'Reilly compares Gays to Al-Qaida! Boycott Fox's Owner "Rupert Murcoch" and get him thrown in jail for illegal - political donations, corruption, greed, bribery, hacking!
  • Boycott Arizona the home of "hater" - U.S. Senator John McCain. Arizona's Hateful anti-Immigration Law - encourages racial profiling and increases hatred towards minorities. A remedy: Demand Republicans to support Immigration Reform (The Dream Act). Further, Senator McCain voted against ending DADT and Blocked Immigration reform!
  • Boycott Target, Best Buy, Gold's Gym - for donating money towards anti-gay political candidates/organizations. Update: (12/26/2010): Target is continuing to donate to anti-gay groups/causes/politicians. Update 03/08/11 - Lady Gaga Ends Target Partnership, Reportedly Over Target's Poor LGBT Stance. Update 3/25/2010 - Target displays their hypocrisy and Sues California Gay Rights Group for Lobbying Outside Stores. Target is attempting to block the LGBT right of free speech! STOP SHOPPING AT TARGET!!!!!!!!!!!!!!!!! Update 4/8/2011: Target lost its case to stop the LGBT from canvassing in front of their stores. A huge PR Disaster for TARGET! Perhaps Target should go out of business as they betrayed their investers and customer base. Target contributed massive funds to a politician who would like to exterminate gays. Now, Target can not stop us from Boycotting them, nor picketing, nor talking to customers near their stores; although, Target allows a anti-gay company such as the Salvation Army to stand outside their door and speak with customers and raise money. Isn't this a double standard?
  • End DOMA (Defense of Marriage Act). Prevents Federal employees and Gays in the Military from gaining equal benefits. Prevents Gay Partners from gaining equal benefits.
  • Pass ENDA (Employee Non-Discrimination Act). ENDA would prevent employment discrimination of LGBT workforce.
  • Boycott Salvation Army as they will not hire Gays! "DO NOT DONATE TO THEM."
  • BOYCOTT "Chick-fil-a" for donating money to anti-gay groups.
  • BOYCOTT KOCH INDUSTRIES PRODUCTS- to include their products: Angel Soft toilet paper / Brawny paper towels / Dixie plates, bowls, napkins & cups / Mardi Gras napkins and towels / Quilted Northern toilet paper / Soft 'n Gentle toilet paper / Sparkle napkins / Vanity fair napkins / Zee napkins / Georgia-Pacific paper products & envelopes / All Georgia-Pacific lumber & building products (INVISTA Products) / Lycra / Stainmaster Carpet. The billionaire - Koch brothers are ultra republican - tea bag founders/supporters that do not support causes of the LGBT community.
  • Boycott WALMART - The National Gay and Lesbian Task Force, force criticized Wal-Mart for denying employee benefits to same-s-x partners and for failing to prohibit discrimination based on gender identity. By comparison, the group said two other chain stores with a strong presence in New York, Costco and Walgreens, did much better.
  • Remember David Kato, Gay activist - Uganda, who was slain because he is gay!
  • "Tune Out Trump", Boycott all Trump Hotel, casinos, holdings, The Apprentice and NBC Network! At CPAC, Trump said he is considering a run for president as a Republican. In a interview with the Des Moines Register, Trump added that he opposes all forms of legal recognition for gay couples, not just marriage. "They should not be able to marry," he said. So why does NBC keep the Apprentice when Donald Trump has stated he may run for president? After making racist remarks about Obama and recv'g public backlash, Trump decided not to run for president after NBC renewed his awful TV Show. How can NBC re-new the clown's show after he pulled such hateful shenanigans? Boycott NBC! Boycott advertisers of The Apprentice and Trump's other business's. Don't shop at any bullding with Donald Trump's name to include Trump Hotels, Casinos, Condo's, Offices, Shops! The Donald has expressed extreme Hatred towards gays and blacks with his birther remarks and anti-gay rhetoric. Remember how poorly Trump treated Rosie O'Donnel? Now we know why he did that! It was hate against a lesbian as we now know he is biget. Unforgiveable! Again, Dump NBC because they air/re-newed Donald Trump's "The Apprentice"! Now the Donald Claims the Long Form Birth certificate is a fraud. And NBC keeps this guy?

Jeers For a Gay Soldier
The Daily Beast, Sep 24, 2011, By John Avlon
The GOP presidential debate in Orlando produced a profile in courage and nine profiles in cowardice.

The profile in courage came courtesy of the brave active-duty solider named Stephen Hill serving in Iraq who chose the Republican debate as the opportunity to come out to his fellow servicemen and the nation via video. He was, of course, marking the newfound freedom to do so granted by the repeal of Don't Ask, Don't Tell. And he was greeted with a chorus of boos from people in the conservative crowd who don't like his kind.

The profiles in cowardice came from the nine presidential candidates on stage who chose to stand through the insult to a military man serving in a war zone, struck dumb by their political calculations. This was an opportunity to speak out in favor of civil rights, to condemn a basic lack of kindness in the crowd, to stand up for our fighting men and women serving in harm's way. It could have been a defining moment for a candidate with the courage and decency to buck the base.

But instead, there was the awkward silence of a political pitch going by--an acquiescence to some of the ugliest impulses in society combined with a lack of moral clarity. And the reason was simple fear--fear of alienating the base and fear of being called a RINO for being in favor of gay rights. It was not a proud moment for the Party of Lincoln.

In the wake of the debate, libertarian Gary Johnson and centrist Jon Huntsman at least had the decency to condemn the crowds' reaction, but that was after the fact. Perhaps not coincidentally, they are two of the few candidates running who do not favor a federal marriage amendment, which would roll back the gay civil-rights movement sweeping the states in favor of a constitutional amendment. Their positions of principled independence in a conservative populist year have them so far mired in single digits. And, to his credit, even the socially conservative Rick Santorum eventually got the message and condemned the boos.

But the two frontrunners--Rick Perry and Mitt Romney--have so far been shamefully silent on the moment in the debate, going so far as to refuse further comment through spokesmen. This lack of courage will look bad in the eyes of history and takes a further chunk out of any claims they will make about how they can be a moral leader of the nation in the White House.

Take a moment to see the crowd's eruption in a larger context of this year's presidential debates. Draw a mental line between the cheers that greeted Rick Perry's proud claim that he hadn't lost any sleep over the 234 (now 235) executions he has presided over as governor in Texas and the giddy applause that greeted Wolf Blitzer's question about whether an uninsured 30-year-old in a catastrophic car crash should be allowed to die or given treatment and, finally, the booing of soldier Stephen Hill.

They are all flashes of an ugly impulse we have seen periodically in our politics--when conservative populism meets with a mob mentality. These are the forces that H. L. Mencken wrote about when he covered the Scopes "Monkey Trial" and what Richard Hofstadter wrote about in The Paranoid Style in American Politics. It is resurgent again in a party that has allowed the fringe to blur with the base, to the extent that otherwise responsible presidential candidates are afraid to condemn it because of the potential political fallout in closed partisan primaries.

The point is not that those boos--or the execution applause--characterizes the entire debate crowd, let alone the conservative movement or even the Republican Party. Let's say, giving the benefit of the doubt, that it was just a very vocal minority, hijacking the debate. Nonetheless, the lack of condemnation speaks to a growing problem in the GOP--evidence that the inmates are coming close to running the asylum, enabled by a cowardice that comes from the pressure to ideologically conform.

Conservative populism is usually, almost by definition, on the wrong side of history. But it has always been a powerful force in American politics. When it is combined with a mob mentality that cheers executions or reinforces bigotry, bad things can happen.

Right now, responsible Republicans are needed to stand up and condemn the extremes on their side of the aisle. In doing so, they can have the comfort in the knowledge that they are following the example of William F. Buckley, who condemned the John Birch Society's paranoid delusions in the 1960s. If they have the courage to state that their belief in individual freedom extends to gays and lesbians, they can do so in the knowledge that conservative icon Barry Goldwater backed gays in the military decades ago, famously saying that "you don't have to be straight to shoot straight." And they will know that they are doing their part to redeem the reputation of the Party of Lincoln.

But if the GOP presidential candidates continue to pander to the lowest common denominator in our politics, standing silent when the mob mentality rears its head, they only provide more evidence of the current field's weakness.
